RoseAnn Frazee and Kirk Laron started this law firm to help families, including multicultural and extended families, solve their legal problems. Family legal problems reach into many arenas such as finances (bankruptcy), family businesses, injuries, real estate, estate planning and marriage dissolutions. We felt sorry for families that run to document preparation facilities without having the proper legal counseling to only find such inadequate preparation or limited documents would not accomplish their particular goal and might even lead to more difficulty, expensive litigation or lost rights. Thus, such documents prepared without attorney assistance could lead to more expense at a later time. For instance, the parties might discover later that they were not in fact divorced, have to pay more in capital gain taxes or, as one judge recently reported, the heirs will end up in his probate court anyhow.
In California 80% of the marriage dissolutions are filed in pro per because the party cannot secure an attorney to represent them. Many attorneys charge a $5,000 to $8,000 retainer fee which most parties cannot afford and, as a result, they cannot assert some of their rights. Although there are Legal Aid and Public Counsel Agencies, they have limited resources, and there is really no “public defender” to represent parties in civil matters. The U.S. Constitution does not guarantee a person legal counsel in civil matters only in severe criminal cases.
